DIESEL FEDERAL ROAD TAXES FOR AG. Effective 10/1/05,
Farmers must pay Federal Road Taxes on all purchases of clear diesel. Farm must now, like other off-road users, file with the IRS for a refund or credit for these taxes. Form 4136 is for a credit against your income tax. Form 8849 is for a refund—(filing limits exist). Don’t forget to file for your refund or credits. See TAX FORMS for refund forms.

DID YOU KNOW THAT SALES TAX IS CHARGED ON FEDERAL EXCISE TAX? Therefore, if you are entitled to receive a refund/credit on your diesel used off road, you are entitled to receive a refund on the SALES TAX that is charged on the Federal Excise Tax. This form is found under TAX FORMS and must be filed with your fuel supplier. Once we receive the sales tax refund from the Board of Equalization we will refund the tax to you.

RED DIESEL IS DESIGNED FOR OFF-ROAD USE ONLY AND DOES NOT HAVE STATE OR FEDERAL TAXES INCLUDED
(by purchasing this product you can avoid paying both the Federal Excise Taxes.) User Beware: Stiff penalties are imposed for using Red Diesel in on-Road vehicles.

STATE ROAD TAXES
Assembly Bill 647 was not passed that would have aligned the state with the federal treatment of Diesel Road taxes. This means that Ag exempt diesel users must still file a certificate with their supplier for purchasing Clear Diesel exempt State Road taxes at time of purchase. See TAX FORMS for Certificate.
